Title: Amend Article XIII Section 1 of the Constitution of the Department of Tennessee

WHEREAS, The American Legion, Department of Tennessee Constitution and Bylaws was last revised June 26, 2004; and
WHEREAS, The current version of The American Legion, Department of Tennessee Constitution recognizes an auxiliary organization known as “The American Legion Ladies Auxiliary”; and
WHEREAS, Some of the Posts in The American Legion, Department of Tennessee have a misunderstanding of the relationship between the Post and the American Legion Ladies Auxiliary; and
WHEREAS, The National Judge Advocate has issued an opinion on the relationship between the American Legion Posts and the American Legion Ladies Auxiliary; now, therefore, be it
RESOLVED, by Post 254, The American Legion, Department of Tennessee, in a regular meeting assembled on November 7, 2018, That Article XIII Section 1 of The American Legion, Department of Tennessee Constitution shall read; The American Legion Department of Tennessee recognizes an auxiliary organization known as “The American Legion Auxiliary”, organized in accordance with the regulations of the National Constitution, and other organizations recognized by the national organization of The American Legion. The members of a section 501(c)(19) auxiliary that is related to a Post are a separately formed organization and recognized as tax exempt and, therefore the auxiliary members are not considered members of a Post.
