Resolution: 2018-26

Title: Amend Article XIV Section 5 to the Constitution of the Department of Tennessee

WHEREAS, The American Legion, Department of Tennessee Constitution and Bylaws was last revised June 26, 2004; and

WHEREAS, Article XIV Section 5 states; “No proposed amendment shall be submitted through the Department Adjutant to the members of the Department Constitution and By-Laws Committee and then to the Department Executive Committee and then considered by the Department Convention, unless the proposed amendment shall have first received the formal endorsement of a Post. Proposed amendments, received from a Post, must receive the formal endorsement of the Department Executive Committee prior to being presented to the Department Convention for consideration”; and

WHEREAS, Article V Section 6 currently states the Resolution Committee may initiate a resolution with the Department Executive Committee; and

WHEREAS, The Department Executive Committee is empowered and authorized to amend the Department Constitution; and

WHEREAS, The Constitution and Bylaws Committee considers all Amendments to the Department Constitution to be referred to the Department Executive Committee; now, therefore, be it

RESOLVED, by Post 254, The American Legion, Department of Tennessee, in a regular meeting assembled on October 4, 2018, That Article XIV Section 5 of The American Legion, Department of Tennessee shall read; No proposed amendment shall be submitted through the Department Adjutant to the members of the Department Constitution and By-Laws Committee and then to the Department Executive Committee and then considered by the Department Convention, unless the proposed amendment is either, initiated by the Resolutions Committee, Department Executive Committee, or Department Constitution and Bylaws Committee, or has first received the formal endorsement of a Post. Proposed amendments, received from a Post, must receive the formal endorsement of the Department Executive Committee prior to being presented to the Department Convention for consideration.

This is to certify that the above resolution was adopted by Sgt. Donnie E. Horton American Legion Post 254 on October 4, 2018.
