Title: Amend Article VIII Section 1 of the Constitution of the Department of Tennessee

WHEREAS, The American Legion, Department of Tennessee Constitution and Bylaws was last revised June 26, 2004; and

WHEREAS, The Department Judge Advocate shall be present in an advisory capacity for all Department Executive Committee Meetings; and

WHEREAS, The Department Sergeant at Arms shall assist the Department Commander and department Adjutant during Department Executive Committee Meetings; and

WHEREAS, The Chairman and four members of the Department Finance Committee, Chairman and two members of the Department Resolutions Committee and Chairman and two members of the Department Constitution Committee are not members of the Department Executive Committee and therefore not required during a formal Call of the Department Executive Committee; now, therefore, be it

RESOLVED, by Post 254, The American Legion, Department of Tennessee, in a regular meeting assembled on October 4, 2018, That Article VIII Section 1 of The American Legion, Department of Tennessee Constitution shall be amended to remove the Chairman and four members of the Finance Committee, and Chairman and two members of the Constitution Committee from compensation upon formal call-in of the Department Executive Committee; and be it further

RESOLVED, That Article VIII Section 1 shall read; Between Department Conventions, the administrative power shall be vested in the voting members of the Department Executive Committee, which shall be composed of nineteen members, which include the Department Commander, the three Department Vice Commanders, the three immediate Past Department Commanders, and the ten District Commanders.  Upon receiving a formal call-in from the Department Headquarters, the expense of the voting members of the Department Executive Committee, Department Judge Advocate, and Department Sergeant at Arms, shall be based on the mileage rate from the individual’s Tennessee American Legion Post, as authorized by the Department Executive Committee and will be allowed per diem rate authorized by National Headquarters lodging for one day as authorized by the Department Headquarters Call.  Individuals must be present for roll-call and remain for the entire length of their respective Called meeting in order to be eligible for claiming expenses and a copy of motel/hotel bill must be presented with the expense report in order to claim the authorized daily lodging. per diem.
