WHEREAS, The National Constitution and By-Laws of The American Legion are in full force and effect and represent actions taken by National Conventions, being the Constitution and By-Laws adopted at the First Annual Convention, Minneapolis, Minn., November 10-12, 1919 and at the Fourth Annual Convention, New Orleans, LA., October 16-20, 1922 respectively, and as amended at subsequent annual conventions; and
 
WHEREAS, Any person shall be eligible for membership in The American Legion who was a member of the Army, Navy, Marine Corps, Coast Guard or Air Force of the United States and assigned to active duty at some time during any of the following periods, with all dates inclusive: April 6, 1917 to November 11, 1918; December 7, 1941 to cessation of hostilities as determined by the United States Government; all dates inclusive, or who, being a citizen of the United States at the time of his or her entry therein, served on active duty in the armed forces of any governments 'associated with the United States during any of said periods; provided, however, that such service shall have been terminated by honorable discharge or honorable separation, or continued honorably after any of said periods, provided, further, that no person shall be entitled to membership who, being in such service during any of said periods, refused on conscientious, political or other grounds to subject himself or herself to military discipline or unqualified service, and
 
WHEREAS, Membership in The American Legion is membership in the national organization of The American Legion by affiliation with Posts and each Post of The American Legion shall be the judge of its own membership, subject to the restrictions of the Constitution and Bylaws of The American Legion; and
 
WHEREAS, There shall be no form or class of membership except an active membership, and social or honorary memberships are specifically prohibited, and
 
WHEREAS, Membership, other than active membership, could be contrary to the ordinances, codes and laws of the State of Tennessee and the communities therein and could be a fiscal liability to The American Legion, to The American Legion, Department of Tennessee and to the Posts; and
 
WHEREAS, Membership, other than active membership is a threat to the preservation of the tax-exempt status of The American Legion, of The American Legion, Department of Tennessee. and of the Posts and is contrary to the Constitutions and Bylaws of The American Legion and of The American Legion, Department of Tennessee; and
WHEREAS, Posts and officers and members of The American Legion shall uphold the declared principles of The American Legion and shall conform to and abide by the regulations, decisions, constitutions, bylaws and uniform codes of procedures of the national organization, National Executive Committee, Department of Tennessee and/or the Department Executive Committee, now, therefore, be it
 
RESOLVED, By the Department Resolutions Committee, The American Legion, Department of Tennessee in a regular meeting assembled in Murfreesboro, Tennessee, February 8-9, 2020, that any Post in The American Legion, Department of Tennessee found to be fostering or maintaining membership, other than active membership, as prescribed in the Constitutions and Bylaws of The American Legion and of The American Legion, Department of Tennessee shall be subject to discipline and penalty, such as revocation, cancellation or suspension of the charter of the Post, as prescribed in the Constitutions and Bylaws of The American Legion and of The American Legion, Department of Tennessee and in the Uniform Code of Procedure for the Revocation, Cancellation or Suspension of Post Charters, adopted by the National Executive Committee of The American Legion and as amended subsequently; and be it further
 
RESOLVED, That any officer or member of any Post in The American Legion, Department of Tennessee, found to be fostering or maintaining membership, other than active membership as prescribed, in the Constitutions and Bylaws of The American Legion and of The American Legion, Department of Tennessee, shall be subject to discipline, such as suspension or expulsion from membership in The American Legion, as prescribed in the Constitutions and Bylaws of The American Legion and of The American Legion, Department of Tennessee; and
 
RESOLVED, That all Posts and their officers and members of The American Legion, Department of Tennessee shall conform to and abide by all local, state and federal laws, codes and ordinances and shall be in compliance with all articles of the Constitutions and Bylaws of The American Legion and of The American Legion, Department of Tennessee and be it finally
 
RESOLVED, That the Department Adjutant publish this resolution annually until rescinded, revoked, or cancelled.
