Title: Amend Article Ill Organization of the Riders Constitution of the Department of Tennessee

WHEREAS, The American Legion, Department of Tennessee Riders Constitution and Bylaws was last amended January 23, 2010; and
WHEREAS, ARTICLE III, Organization of the American Legion Constitution guides our every action with its guiding principles; and
WHEREAS, The principle, Organization as currently written needs to be changed: “The American Legion Riders will be organized at The American Legion Post. Each Post ALR exists at the discretion of the sponsoring American Legion Post. Posts desiring to charter an ALR unit, will submit an application for a Legion Rider Charter to the Department Adjutant. Minimum number of paid current American legion, American Legion Auxiliary and SAL members is five (5), of which three (3) must be eligible paid current Legionnaires. Legion, Auxiliary and SAL membership dues must be paid current at all times in accordance with edits of their respective Department or Detachment Constitution and By-Laws. Approved Charter Applicants will receive a "Post Legion Rider Charter" from the Department. Issued charters will be signed by the Department Commander. The cancelling of ALR Charters rest with the Department Executive Committee (DEC) of The American Legion. Said decisions of the DEC are final;” therefore it be
RESOLVED, by Greenbrier Post 45, The American Legion, Department of Tennessee, in a regular meeting assembled on 05 November 2019, That the Definition of ARTICLE Ill - Organization to the Riders Constitution of The American Legion, Department of Tennessee shall be amended to read:
“Any Post of The American Legion Department of Tennessee may establish a local Tennessee American Legion Riders organization by application for same to the Department (State) Adjutant payment of all approved fees and verification of members' eligibility.
Section 1. Application for establishment must be completed by duly elected officers of the Post and contain the names of all members.
Section 2. Approved Post Riders organization will be subject to all applicable provisions of the Department of American Legion Department of Tennessee American Legion Riders Constitution and Bylaws.
Section 3. A Post Riders organization in violation of The American Legion Department of Tennessee American Legion Riders Constitution and Bylaws Constitution will be suspended, and all members will be denied voice and vote in Department meeting.
Section 4. There will be no official organization of Tennessee American Legion Riders in the Department of Tennessee other than those approved by the Department Executive Committee. The Post Riders organization may from time-to-time cooperate, coordinate or come together to conduct joint activities under the auspices of their American Legion Riders Department of Tennessee, as long as the event is properly insured by the host riders post.
Section 5. Must have a minimum of five (5) members to start a Post Riders organization. Of these five (5) members, three (3) must be eligible paid current Legionnaires.
Section 6. Posts of the American legion are not required to maintain Constitution and Bylaws for the program of the American legion; therefore, The American Legion Department of Tennessee "Legion Riders Constitution and Bylaws shall be the sole governing document for Post Riders in the Department of Tennessee.
